Switching from Tier 2 General to Tier 2 Dependent

Hi,

I am in serious need of some help. I am in the country on a TIER 2 General visa. My husband is my PBS dependent. I recently lost my job.

I am wondering if it is possible for my husband to change to TIER 2 General (his company is willing to sponsor him) and for me to become his dependent.

- Is that allowed?
- Also will our "counters" (for ILR) be reset?

Yes, he can move to Tier 2 general visa he his company agrees to sponsor him. However, he will have to go back to home country and apply for entry clearance.

Unfortunately, your ILR clock will get reset with this swap.

Not to forget that he will need a rCoS (not uCoS).

Thank you ! Are you sure about the home country bit? I thought after a recent judgement, in country visa switches were possible.

Not sure what recent judgement you are talking about. As per the guidance, only specific switch are allowed (you can refer the T2 guidance for details). In your case, your husband will need a restricted CoS as sush mentioned. Once he has that, he will have to apply for entry clearance from his home country.
