I am seeking advice related to TIER 2 General Visa and TUPE transfer for the employees who are on Tier 2 General (work permit)
I have been working with Company A and received Tier 2 general visa in Dec 2013 which is expiring in Dec 2016.
Company B has taken over the contract and my visa is still valid for 1 year till December 2016
I will be transferred to work for Company B via TUPE. I want to know if there are any legislation/rules that clarifies the formalities to get TUPE transfer for the employees who are on sponsored Tier 2 Visa (Work Permit) so that I can continue my employment with Company B.
I have gone through the details in Tier 2 sponsor guidance (13.1 - 13.9). It says that Company A needs to inform to UKBA via SMS (Sponsor Management System)
Company B is already having Sponsor licence and I want to know whether Company B also have to inform UKBA that they are employing a migrant and mention their Licence number.
If both companies have informed UKBA via SMS and after that Do I need to get my BRP card amended with Company B sponsor licence number? Do I get a letter from UKBA confirming the change of details?
Also I want to apply for dependent visa for my wife in December and I will be moved to Company B from 1 January 2016 therefore should I wait till my HR informs UKBA about the change or should I apply for visa
