Hi

I greatly appreciate if someone could help me to find answers to the following queries;

Current situation: I recently got married (outside the UK), but both of us have been living in the UK for the past 5 years (under Tier 4 and Tier 2 visas). I’m currently working under Tier 2 (General) which will expire in January 2017. My wife is currently in the UK under Tier 4 (Student) which will expire in February 2016. Now my wife is hoping to apply for a switch to Tier 2 Dependant within the UK on her own.


Queries:

1. Is there a specific form for this type of applications as I am unable to find in https://apply.ukba.homeoffice.gov.uk/iapply.portal ?

2. Can my wife apply on her own within the UK? (as there is no reason for me to reapply at this stage). Can she apply using the premium service to get it same day as the option cannot be found on the above link.

3. Tier2 A-rated Sponsor (my employer) will issue written undertaking that it will maintain and accommodate my wife for a month if needed (limited to at least £630). Is this sufficient to support maintenance requirement of her application or do we have to show bank accounts? If so can I show my bank accounts rather than hers?

4. We have our marriage certificate and photos of the marriage to include in the application. Is this sufficient or do we still have to show additional proof such as joint bank statements, council tax bills, medical registrations, utility bills etc.?

5. Do we have to provide proof of tenancy agreements of residence in the application? We recently moved to a house share and have not received much paperwork to show under our names.

6. Finally, regarding Immigration Health Surcharge: It says £200 per year, since my visa is only valid for 1 more year I guess my wife will only receive her visa for 1 year. But when I went to pay on the website, the calculator showed that she has to pay £600 (for 3 years). Is this correct?

4. How recently were you married? Have you been living together (in UK) since then?
5. No.
6. Calculate your immigration health surcharge.

Thank you very much for the replies Vinny and Sushdmehta.

I see from Vinny's link that the law has changed in 2013 allowing switch to PBS Dependant within the UK.

However the application form in the link which sushdmehta mentioned, asks quesntions such as Is your job in shortage occupation, what is the length of your cos granted etc. This looks like an application for a Tier2 main applicant, not dependant. Does my wife need a cos to apply as a dependant?

Regarding no. 4 sushdmehta's reply: we have been married for a month (outside the UK) and have been sharing a house with another party.
