Will business travel affect my ILR?

Post by jaguar999 » Thu Dec 17, 2015 12:11 pm

Hi Members,

I am on Tier 1 Dependant Visa and have 3 more years to live in the UK before I apply for ILR.

I need to know if travelling to Germany for 2-4 days a week for work (Jan '16 to June '16 or more) will adversely affect my IRL application or not.
A friend told me that if its NOT a personal holiday/migration, and is only for UK office work reasons then the days spent outside UK is not counted. Also there are two kinds of Visa my company can apply for me. One is business Visa and Other is work Permit.

Kindly help me with the below questions

1. Is the limit of days outside of UK at the time of application is 180 days in each of the last five year? Or 180 days in the total of last five years? Or 180 days in just the last year (5th Year)?
2. Should I take this opportunity to work for a project in Germany given by my current company?
3. Will the two types of Visa (Business Visa/Work Permit) cause any affect ? My company is wanting me to apply Work Permit.

I would be really grateful if you guys can answer my questions.

Regards
Gaurav

PBS dependant is not subject to "absences from UK" requirement. But it is expected that the migrant spends more time in the UK than outside.
Given that the project will hopefully last 6 months or so, and you will be away only a few days every week, you will be fine.
Life isn't fair, but you can be!
