Indian passport for UK-born child of Tier 2 (ICT) parents

Indian passport for UK-born child of Tier 2 (ICT) parents

Hi,
I am holding Tier2 ICT visa for 1 year (expiring in Sept 2016) from India. My wife is also holding Tier2 dependent visa and is in UK with me currently.

She is expecting a baby in June 2016. Now I am confused what to do and how to do.

1. Birth registration is required in Indian Consulate in UK.
2. Need to apply for Indian Passport.
3. Do I need to apply for Tier2 dependent visa for the baby?

I want to understand how much time will it take to complete all the three above processes. We need to return to India in Sept 2016.
What do you suggest where my wife should deliver the baby UK or India?

1. Birth registration is required in Indian Consulate in UK.
Birth registration / birth certificate will be given by the local register office (UK). I believe there may be an online option as well, so just check gov.uk website.

2. Need to apply for Indian Passport.
Yes. This is must as you would be travelling back to India in Sep.

3. Do I need to apply for Tier2 dependent visa for the baby?
Unless you plan to go out of UK and enter back in the UK before your current visa expires there is no need to take Tier 2 dependent visa. It would be waste of money (my opinion).

Passport work is the main work for you, but now everything is done via VFS centres, so should be pretty soon. Look for the timelines they mention on their website..and if needed go for priority service.

That would be your/your wife's personal choice to be honest. Your child will still be Indian citizen even if the delivery happens in the UK (assumption: both of you hold Indian citizenship). NHS care may be better (subjective again), however, you may not have extended family to support your wife during/after delivery. If delivery in India, then help from extended family.. but you may not be with her all the time (guessing based on your job here) and may have to travel just for the delivery or wait until Sep to see your son/daughter.

Return? No extension?

If so,
1. No point in applying visa for child if child is not travelling outside UK between birth and your exit from UK. The child doesn't need a visa to exit UK.
2. (and since you've asked) - No point in having the child in UK, IMHO, as nothing will be gained unless you see yourself settling in the UK in the future. Or unless you consider NHS care a priority as compared to support from family before, during and after delivery. If I were you, I would avoid the hassle of birth registration, passport application etc. .... as a matter of necessity (birth in UK) with added pressure of getting everything done in time, all alone, before your return ... rather than choice (birth in India) and at your conevenience.

Birth registration and then Indian passport issuance should not take more 2 weeks if applied for one after the other without delay, and in London jurisdiction. A month probably if you are outside the London jurisdiction and have to deal with Birmingham / Edinburgh etc..

Thanks for your suggestion.

I have no plan to get settled in UK and nor to extend my visa.

Does the baby born in UK have any other problems during his/her study or career in India due to the fact that place of birth is UK?

Does the baby come under NRI quota in India though all of us have Indian citizenship?

The fact that an Indian citizen child is born outside India does not make him/her an NRI nor is he/she deprived of any rights as an Indian citizen.
