TIER 2 EXTENSION EXPERIENCED (PRORATA SALARY)

Post by PeterKum » Sun Jan 24, 2016 7:41 pm

Hi All,

I hope you can help me. I am currently on tier 2 visa which the employer has granted me for 1 year from April 2015 (from tier 4). The time when I applied, I was switching from tier 4 and my age was 25.

However my visa is about to expire in April 2016. I have found out that my status will be 'Experienced entrant' as I am 26 now. The salary right now for me is 22000. However since I am applying for Experienced route, the salary threshold for Chartered Accoutants (SOC 2421) is £28600. My employer will never agree for that salary as it is very early.

]Hence I was wondering if I allowed to lower my salary as Experienced Entrant through Prorata by decreasing the number of working hours from 39 hours to 30 hours so that my actual disclosed salary will remain above 20800 but below £23000.?? I would really appreciate if someone could help me out please?

Simple answer - no.
On secondary point you are almost certainly in a a non genuine vacancy as well under that SOC as it is for fully qualified accountants only. Fully qualified means actually completing your post qualification professional requirements and being fully chartered or certified.
So the role you are in does not qualify and any jerrymandering of your salary will highlight that.
Best to think about a new role that is actually genuine...
