Settlement Visa - Wife

Post by zeekkhan » Wed Mar 02, 2016 2:48 pm

Hi I need a quick advise. My wife came to UK on Tier (1) General dependent Visa in August 2011. I have switched my visa to ILR on long residency basis in February 2015. I have applied for my wife spouse visa FLR(M) it was refused because we have provided wrong English Language certificate. We have appeal against it and in the court home office withdraw their case because we have British child. Now my wife received BRP and they have given discretionary leave.
My question is Should she stay on discretionary leave for next 5 years and in 2021 she will apply on 10 years long residency basis because she enters in UK in Aug 2011 (No gaps) or Should she apply for spouse visa and after 5 years we will have both options long residency and ILR on spouse route?
