submit with in 28 days after visa expired

Post by lanzhou1 » Fri Apr 01, 2016 5:30 pm

Dear All,

Please give me a suggestion.

I am now waiting for the bank statements...it took longer than I expected since the Easter.

My visa is expiring tomorrow.

everything else are ready.

Do you think I should submit the application with a cover letter says I will post them the bank statement couples days later seperatly.

Or I should just wait couple days and submit all in once. (visa will be expired but within than 28 days )

urgently reply needed.

many many thanks.!!!!!

If your visa expires before you apply, your application will be considered out-of-time which means section 3C will not extend your leave and you will become an over stayer.
Migrant’s status following submission of an application within 28 days of overstaying
The submission of an application within the 28 day period of overstaying does not mean the migrant’s previous leave is either re-instated or extended. Therefore an applicant without valid leave at the point they submit their application continues to be an overstayer from the point their leave expired and throughout the period their application is pending.
As the applicant has no leave during the period their application is pending they have no permission to work in the UK
I believe you can apply with a missing document from a series (like a missing bank statements) and according to rules, the case worker has to apply evidential flexibility and ask you to submit the missing document in series. There is still a risk that this will not happen

Thanks.

but will the HO accept the documents posted to them later...I heard many cases that the later submitted documents are missing and HO just ignored them then refuse people.

:(

Generally they don't accept it unless your missing document is from a series. The case worker is then required to apply the evidential flexibility rules.
You had 3 years to prepare for this, do not expect miracles on the last day :?

Instead of sending application without statement or waiting for it and not knowing how long will it take go to bank they will print online and stamp which is acceptable by HO and if u want u can also write cover letter explaining situation.

@lanzhou1,
Sorry for being a late respondent to your query, Don't worry at all, just go to the bank( like one of the member has already suggested)request them a print out and get them stamped each and every page of the statement. I always do so and have never ever had any issue and even the policy guidance of all the point based applications say so.
