Tier 2 General-extension refusal

Hello Friends,

My tier 2 general visa-extension have been refused because of less salary shown in the CoS. My HR thought that salary shown in the Code of Practice is for 40 hours and accordingly she took the pro rata salary for 37.5 hours. When my visa got refused we come to know that salary mentioned in the code of practice is based on 39 hours. So, there is a difference of 36p/hour in my salary.

Me and My company have decided to apply for new CoS and in that they will increase my salary as per the code of practice.

Visa refusal date-1st April
Current Visa valid up to-14th May.

I want to whether the decision taken by us is correct or not. further what are the chances of getting the visa in reapplication with the new CoS?

Hi All,

I am sorry for posting this as a reply, but we also did the same, when we applied for Sponsor Licence. My salary is lower than the one given in SOC guidance but we based it on 35 hour week. My SOC is 3545. Is this a good reason to be refused? Also, the solicitor gave me the copies of the certified copies of the supporting documents, which worries me a lot. Will they refuse the application because of that?
