Dear Members,

Latest policy update

In order to obtain ILR (Indefinite leave to remain) and later, naturalisation applicants cannot have spent more than 180 days absence in one year. Under the old rules, the time between the visa issue date and the date of their first entry into the UK was not considered an absence if the person had entered within 90 days of their visa.
As of today, the time between the visa issue date and date of first entry WILL be considered an absence towards the total 180 days absences allowed in that year.
Is that applying on the initial application done in 2014? because the guidance in 2014 did not contain such this rule. Many people who did not calculate that period will face a problem in ILR.

Entry clearance grants you extra 4 months on top of the 3 years to enter Britain (totally you get 3 years and 4 months) Why did you arrive so late without a compelling reason ?? If such an absence at the end of your qualifying period is going to be a problem, you need to demonstrate what was the exceptional reason for why you arrived so late in the first place.
Even under previous rules, any period beyond 90 days between your visa being issued and entry date was NOT counted towards your continuous period for ILR.

My visa date is 18 Jan 2013
My Entry date id 26 March 2013
and my visa expiry on 18 April 2016
i have invested 200000 GBP with more then 10 Employment can any body tell me due to new guidance can i eligible for 3 years accelerated route and eligible for ILR please tell me thanks

I have 2 companies and 12 full time employee is working to date I have only concern regarding my duration of stay if I apply 17 April 2016 for 3 years accelerated route so how they count the person is that count April 2013 , 2015 And April 2016 if they count or they counted my visa granted date that was Jan 2013
As I previously mentioned that I came here after 70 days

From 26 March 2013 to 18 Jan 2016, how many days did you stay in the UK and spend outside the UK.

Babaj,

The preparation for extension/ILR is a huge amount of work and receiving a lot of original documents from many entities (banks, accountants) my Extension was over 1000 pages ( I agree crazy) so if you are not in advanced preparations get your act together you have 9 days...

You need min of (3 years minus 28 days ) and only up to 180 days absence in each year since the date your visa was issued. The time spent outside UK before coming to the UK will count towards the 180 days absence.
