Tier 2 (General) Extension Refusal Financial Requirement

My employer didn't realise that I needed to be paid at the experienced rate so my application was rejected. My visa has now expired and my employer wants to keep me and is prepared to pay me at the experienced rate. I am still in the 14 day AR period but there is no point in a review. My employer can issue a new CoS but my questions are:
1 should the CoS be for a new Tier 2 (General) visa or for an extension as before - as it was their mistake
2 what dates should the CoS be requested for as my last visa has now expired
3 my biometric card has been retained/destroyed so I can't submit it with my application - what should I do?
4 my documents are still with the Home Office - how do I get round that?
5 I'm planning on making a Premium Service application - is that a good idea? I need to keep any period of overstay as short as possible
Any assistance would be very gratefully received.
