Spouse Visa

Hi,

Me and my partner are in the process of applying for Spouse visa.

He came in UK in 2012 on student Visa and did International Foundation Programme for a year. He then joined undergraduate course In Accounting and finance at the same university( Staffordshire university). During his second semester of university just before the final exams he had to go back home(Pakistan) due to my Father’s death.

After that massive shock he was not able to carry on his course and he was given Higher education certificate from my university as he had finished his first year of university successfully.

Me and my partner lived together while he was in the UK for more than 2 years and now we are married. I wanted know the if the english Evidence he has would be enough to meet the requirements for spouse visa application.

He has been granted Student visa (tier 4) twice once outside the uk and once inside to do study future degree course( Accounting and Finance)



Evidence list below

IELTS (academic )Test done in 2012( Score 5)
Finished intentional foundation programme 2012-2013 Certificate with transcript
CAS letter and letters from home office evidence of extension to his student in UK for Accounting and finance applied within the UK
Certificate of Passing first year of university with transcript.
Reference letters from teachers of Both Foundation and undergraduate degree course.

He lived in UK for more than 3 years from 2012 to end of 2015

He is currently is in Pakistan and I am in the UK.

Any help will be much appreciated :)

English requirement for Spouse Visa

Hi,

I recently got married, my husband is a Pakistani national.
Up until the end of 2015 he was on a Tier 4 student visa.
He has been studying in the UK since 2012.

According to the english language guidance I found online, https://www.gov.uk/government/uploads/s ... _clean.pdf he won't need to do the English language test again.
This page tells you which migrants are exempt from the English language requirement under all applications except Tier 1 (General).
You can award an applicant 10 points if they have ever been granted leave as a:
 Minister of religion (not as a Tier 2 (Minister of religion) migrant) under the rules in place on or after 19 April 2007
 Tier 2 (Minister of religion) migrant if, when they were granted that leave, they obtained points for English language for:
o being a national of a majority English speaking country
o a degree taught in English, or
o passing an English language test
Tier 4 (General) student and the confirmation of acceptance for studies (CAS) used to
support that application was assigned on or after 21 April 2011 for a course of at least degree level study.
Have I understood this correctly and does it apply to spouse visa?
