as I am british citizen lives and work in Germany I have rented apartment and I have jobs.

my question is

my young brother 16 years old come to Germany illegaly

how can he be my dependent and can he benefit from eu darictive 2004/38/ec

- that is, with you as head of household (when you were an EEA national)?

How long have you supported brother for, financially?

he is here in Germany under immigration things

and I have give him cash some times while he is here.


he is member of my household from today.

In general, to qualify as an EFM you would need to show brother has a history of dependency &/or membership of your household, as well as ongoing dependency/ life in your household.

I don't have history supported him but I have helped my father when I went home,he were dipeand on my father before he were leave my country,but now we are both with another brother lives in same house.i am wondering if he can depend on me from today?

No worries. That's why the forum exists.

Not sure enough dependency exists here; remember you will need good supporting documentary evidence of all this.

I don't know if Germany also makes local requirements in a wrapper around EU law.
