Its not very clear what you're trying to do...
Live in Germany?
Get divorced / register a divorce in Germany?
Go to Iraq to marry someone?

I don't know what Germany requires in terms of proof of your marital status.
In principle, once living in Germany (and recognised as single) you may take a holiday abroad and return with new spouse.
Yes, spouse would need to enter Germany on Schengen visa if not from a visa-free country.

Don't start playing games & lying to the authorities.
Once on record such deception will count against you at some time.
German authorities can best advise on German visa requirements.

It seems some domestic German requirements have to be met in terms of proving your status.
Suggest you need to ask a German migrant support organisation or stand by here for a member from Germany.

You will have to be patient. As noajthan has already advised, this may not be the right forum for you as there may not be any members available with knowledge of German registration requirements.
