Lawyer to Speed Up COA?

Post by rlgrod » Thu May 05, 2016 7:14 pm

Hi everyone,

Here’s my situation:
My 6 months EEA visa expired on the 2nd of May, 2016, and on this same day I started to work at as a manager at a company. I worked for 3 days as a trainee, but hadn’t yet signed the contract. On the third day my employer told me that, since my visa was expired, I wouldn’t be able to continue working for him, and sign the contract, until I had some sort of documentation proving I can still legally work in the UK. However, even though I already sent in the documents for the Residence Card (EEA2) on the 3rd of May, I explained to my employer that my husband is an EEA National (Spanish) and is a qualified person, since he’s working, and therefore exercising his treaty right, which makes me legally allowed to live and work in the UK, even after the expiration of the EEA visa. He confirmed this information on the government website and acklowledged that I can legally work, however, the company’s legal representation (layers) advised my boss to still ask me for a document stating preciselly the fact that I can legally work. I haven’t yet received the COA letter that states my ability to work, but there’s no telling exactly how long that’s going to take (the fee was deducted from my account today).
I’m at risk of dismissal because of this.

Question 1: I phoned 4 different immigration lawyers and 3 of them said it’s impossible to accelerate the expedition of the COA letter, but 1 one them said they can help get it expedited in 7 to 14 business days, and asked me 500 pounds for it. Do you guys think this is actually possible or is this lawyer trying to trick me out of 500 pounds?

Question 2: For my employer to check my work status on ECS (Employer Checking Service) website, he needs my Case ID number, which comes with the COA letter. Is there anyway to get this number before receiving the letter, because all the UK Immigration numbers I called, and also the European Help Line, told me that they cannot access the files and get this number for me. I was told by a person from the European Help Line that I should send a letter requesting my Case ID in writting to an address in Liverpool, and that that was the only means to get this number before the COA letter. Is there anyway I can get this number?

Question 3: Can the Job Centre or Citizen Adviser provide me with a written statement that I can legally work?

I’m really desperate because I left my old job for this one, and now I have no job because of this.
Thank you guys. I appreciate any help you can give.

Rita

I'd love to know how exactly a solicitor can expedite the process. There is nothing that the job centre or citizens advice bureau can do to speed up the application.

I wanted to know if the Job Centre or the Citizens Advisor can give me a written statement affirming my right to legally work even with an expired EEA FP. I know they cannot speed up the application. About the lawyer, she said she can get the COA letter (only the letter, not the RC) expedited quicker in 7 to 14 business days. I'm inclined to think this is a hoax, but was curious to see if maybe other people had similar experiences.
