mexican-british TRANSIT VISA TO USA

HELLO, I AM A MEXICAN PASSPORT HOLDER, I JUST BOUGHT A TICKET TO MEXICO FROM THE UK, THE FLIGHT IS: EDINBURGH-DUBLIN, DUBLIN-CHICAGO, CHICAGO-GUADALAJARA (MEXICO)..

IN ORDER TO TAKE THE FLIGHT CHICAGO-GUADALAJARA I HAVE TO PASS THE CUSTOMS IN ORDER TO GET MY BACKPACK AND THEN CHECK-IN FOR THE CHICAGO-GUADALAJARA FLIGHT.. SO HERE COMES THE INTERESTING STUFF.. AT THE TIME OF MY FLIGHT I WILL HAVE BRITISH NATIONALITY (I AM IN THE PROCESS OF NATURALISATION), SO I WILL BE MEXICAN-BRITISH, SO THE PROBLEM IS THAT I DON'T HAVE A BRITISH PASSPORT YET.. AND I WON'T HAVE IT BECAUSE IF I APPLY FOR ONE I WON'T GET IT ON TIME (I WANT TO SPEND CHRISTMAS WITH MY FAMILY IN MEXICO).. SO.. DO I NEED A TRANSIT VISA OR NOT?.. IN THE AIRPORT I CAN SHOW I AM ALSO BRITISH BECAUSE I WILL HAVE THE HOME OFFICE LETTER THAT PROBES I AM BRITISH CITIZEN, BUT MY PASSPORT IS A MEXICAN ONE...

Also, i used to have a USA tourist visa for 10 years, but it expired last february...

Can anyone please give some advice?

Unless you have a British citizen passport, the Americans will treat you as a Mexican citizen.

so i will need to pay 50 pounds for a transit visa to stay 4 hours in the international airport of Chicago?

Or get a new tourist visa. Or reschedule your flight to avoid U.S. territory.

THANKS FOR YOUR REPLIES.. ONCE IN MEXICO I CAN GET A BRITISH PASSPORT, SO I DON'T NEED A TOURIST VISA ANYMORE, IF I DON'T GET A BRITISH PASSPORT NOW IS BECAUSE I DON'T HAVE TIME, IF I APPLY NOW I WONT GET IT ON TIME TO FLIGHT FOR CHRISTMAS... I PAID MY FLIGHT TICKET ALREADY SO NO WAY I CAN CANCEL OR CHANGE IT..

BRITISH NATIONALITY CERTIFICATE WOULD DO THE TRICK?

If you try to enter the US with your Mexican passport and without a visa you will get deported. As a result you will never be able to enter the US without a visa, even with a British passport.

You can either get a British passport or buy another ticket travelling through Spain.

He won't even get as far as that as he would be refused admission by U.S. Immigration in Dublin, even if the airline allowed him to check-in (which they probably wouldn't).

You are right, I hadn't spotted that he was flying through Dublin.

You are right, I hadn't spotted that he was flying through Dublin.
Although a refusal by U.S. Immigration in Dublin would still be on his record, he obviously couldn't be deported as he would not be on U.S. territory (preclearance areas remain under sovereignty of the host nation).

In any case it's academic as he probably wouldn't be allowed to check-in.

In general, travelers in transit through the United States require valid C-1 visas. That is unless they are eligible to transit the United States visa free under the Visa Waiver Program (VWP), or they are a national of a country which has an agreement with the United States allowing their citizens to travel to the United States without visas.

Maybe you should ask the US embassy or Chicago immigration officials desk, if you need further validation.

AFAIK, you need prove of nationality, and that is usually a passport. Think about it; if, say, I am a dual national with the UK and Mexico, but I fly to the USA with a Mexican passport, why would/should they treat me as a British traveller? I may well be a British citizen with the right to enter the US under the VWP, but I am not flying as a British citizen, I chose (or had no choice but) to travel as a Mexican. So....even though you are, or would be, a dual national, you are entering with a non-VWP nationality and passport, and as such you need a visa.

Indeed, I remember years ago I travelled with a non-EU national to the US and they wanted to see her US visa before she was allowed to check in.

It's not confusing at all: to qualify for the VWP you need a British citizen passport, not just British citizenship.
