Claiming Pension Credit on Indenite Leave to Enter

Post by jjp2014 » Thu May 19, 2016 6:58 pm

Hi

Can anyone suggest what does settlement visa with Indefinite Leave to Enter means ? Is it same as Indefinite leave to remain ?

I have a friend who came in the UK to join child on the settlement visa stating Indefinite leave to enter. Is it categorized as a permanent resident - ILR. She has been 7 years on this visa and now reached to retirement age. Can she claim pension credit/benefits on this visa ? Visa does not state no recourse to public funds.

Also, in future, if she applies for citizenship, does claiming pension credit affect the citizenship application.

Please advise,

Thanks

ILR = Permanent residence issued within the UK
ILE = Permanent residence issued outside of the UK

Your friend is not under Immigration control and can claim any entitlement to benefits including Pension Credit. This will have no adverse affect on her BC application.

As more than 5 years has lapsed since ILE was granted she should be OK. I gather this was an adult dependent application under the old rules? With that, the sponsor would sign an undertaking for 5 years, which means that the sponsor is criminally liable if the applicant has public funds in the first 5 years after being granted ILE, even though the applicant is not subject to immigration control from date of entry.
