child benefit help

good morning,

i applied for child benefit of my 2 children, 1 bron in uk and other one bron out side EU. for one child it was smoothly done but for 2nd child they are looking for passport and orignal birth certificate.

but here is issue as i applied for them for the EEA permit and all that documents are in the home office. i wrote and explained it to them and sent them Orignal COA that thier application is in home office and they are clearly said that it will take 6 month to get that documents back.

but they child benefet office is keep asking for orignal passport and birth certificate. they refused my child benefit and it is now on mandatory reconsideration. they again send me a letter that i have to show them orignal passport and birth certificate :oops: untill 10th of june or i should withdraw my Application for child benefit and child tax credit.

then i request home office to return passport and birth certificate they answer

" As you have no basis of stay in the U.K we are unable to return thisdocuments at the present time. Act 2004 gives the secetary of state powers to retain the passport of .......... as you have no valid leave to remain in the united kingdom and may therefore be liable to removel "

but my wife have COA till 13 Aug 2016


can any body help me in this satuation please

Its not clear - who has applied for child benefit, you or wife?

Whose passport is being requested, yours or wife's or child's?

Who is being told they have no leave in UK - you or wife?

Are you British?
Is wife non-EEA?

i am british citizen call my wife and children through SS route.
i request my daughter passport as child benefit office want to see orignal passport of my daughter

i applied for my children child benefit on my name. my wife is non EU and her and my children for EEA 1 application is in home office.

i request my child passport from home office and home office said to my wife that you dont have leave to remain so they cant gave us my daughter orignal passport
