Tier 2 ICT Long term staff migrant visa 5years

Post by HUMPHREY » Sat May 21, 2016 8:26 pm

Dear All,

I came to UK in 2012 March on Tier 2 ICT Long term staff visa and following are the visa applied that I had since. I'm working at the same company.

'Tier 2 (ICT) Long term staff
Valid from - 26/03/2012 to 25/04/2015 -- 3 Years

Extended Tier 2 (ICT) Long term staff leave to remain
Valid from- 07/04/2014 to 07/04/2017 - 2 Years

I have been told from my company that I need to be back my country (Hong Kong) for one year and come back to UK for apply another visa. So my question are below:

1/ can I extended my visa without come back to Hong Kong for one year?
2/ Any different type of visa I can apply to extended for stay UK, not coming back to hong kong for one year?
3/ after 1 year back to hong kong, what sort of visa I should be apply? how long I can apply permanent residence?

I would really need your help / views on this as i am getting mixed feedback from different people.

Appreciate your advice and comments!

Best Regards,
Humphrey

You can only extend your ICT visa beyond 5 year (up to a total of 9 years) if you earn > GBP 155,300 pa. Otherwise, a cool-off of 12 months will apply and you can again apply for another ICT Long term visa from your home country after 12 months.

You cannot apply for UK residency on ICT visa. It has been stopped from Apr-2011. If you are looking for settling down in UK, you will need to find a sponsor in UK who is ready to sponsor Tier 2 General visa for you. As per current rules, T2 General still allows long term residency. However, even in that case, you will be subject to a cool-off of 12 months before you can apply for the visa from your home country.
