delay in submitting visa extension

Post by NOM » Mon Nov 26, 2007 3:00 pm

hello,

i am mphil student here in uk and my husband is dependant on me.i have submitted my visa extension application form only one day delay as my visa expired on 31 sep 07 but it was sunday so i have posted it on 1 october 07.but home office rejected my and my husband visa because of only one day delay.they haven't give me any right of appeal as well.i have very good immigrtion history. i came here there years before. first i did Pgd in Public Health than 2 year master in the same field and now i am doing Mphill in the same field. my classes already started in sep and rt now i m in middle of studies.
i have alreay sent representation thru my lawyer three weeks before and still waiting for reply from home office.

could anyone plz advise me what i have to do?or is any one else who have the same problem cos we will go for judicial review as well.

thanks

You applied late, and therefore were in breach of the immigration rules. You can ask for reconsideration, but if that is refused you will have to go back home and reapply.

thanks victoria,

could you kindly tell me

1.about representation which i have sent already. so how long it will take normally.now its 4 week is going on? should i wait for reply? or launch JR.
BECAUSE i am in great confusion as i m in middle of my MPHILL which was my dream. if i stop and go back so it means i have wasted my all 3 yeays here.

2. is it worthy to go for judicial review?

You overstayed your visa so the refusal was lawful. I can't see how you have grounds for any kind of JR.
