I don't understand you either you qualify for Ancestral visa or not .


This is very clear cut, so the HO should not be dilidaling around.


The only other thing that maybe they want you to make the application from your home country.

Before you do anything else, I think you need to see an immigration specialist who can go through the various dates of application/refusal/appeal with you, with a view to determining whether you are still considered to have continuing leave. It is possible that you have technically been an overstayer since your original appeal was determined.

Even if you are still lawfully in the UK, for a settlement application to succeed you need to show that you entered the UK in possession of a settlement visa, and you didn't. It is likely, therefore, that any COA application followed by a settlement application to the BIA will result in refusal simply for that reason.

I'd cut your losses: get married, leave the UK and apply for a settlement visa at the relevant High Commission.

I agree.

You can't get an ancestral visa from within the UK anymore, so this is likely to be refused. But if you've been working or studying in the meantime, you could be in trouble.

You came here as a visitor, is that right, and during the currency of that leave, applied for leave to remain as a student.

that was rejected, and AFTER the rejection, you put in an ancestry application?

If so, you have been an overstayer for years.
