Tier 5 youthmob applied for FLR(M) Spouse - Please help us!!

Hi there

Me and my husband are in some desperate help regarding our FLR(M) visa we applied for 6 weeks ago. I came to England from Canada on a youth mobility(tier 5) visa and meet/married my english husband. My visa is coming to an end in a week and we have applied for our spouse visa FLR(M)

We received the letter in mail right after post as well as request for biometrics so everything has been exactly on track so far. :D

A few days ago we received a letter requesting to clarify some details. They asked for 6 months’ worth of payslips and also employers letters. We have neither.

My husband is self-employed and is a director of his own company. We meet the financial requirements through my husband. Who would be my sponsor. This seemed to be completely fine as was highlighted in FLR forms.

I was working for a company for 18 months but left in September to start my own business.

Therefore, Neither of us have payslips covering the past 6 months as we have both been self employed nor do we have employers letters from this time either as we weren’t working for anyone else.

We have written a very detailed letter repeating/ proving what we have already stated in the application forms. Has anyone else been in a similar position or have a spouse that is self employed? Any challenges faced around this? Any thoughts or advice would be extremely appreciated.

What evidence of income from your husband's self-employment was submitted? Did this include an HMRC annual self-assessment tax return and/or annual accounts? Does you husband's annual income meet the £18,600 after allowances or deductible expenses which are not taxed?

If he is a director of his own company (and presumably an employee too) he is legally bound to issue payslips to himself and register the company with HRMC on the RTI system so they can see the salary/PAYE payments being made as they are issued. Being a director is not self-employment, he is a regular employee of a Ltd Company irrespective of who owns it.

I'm on a course of 'on-the-ball' pills as prescribed by the doc after a few recent lapses on the board!
