Non EEA Parents Visa - EU Treaty

Hi,

Im a British citizen, assessing the options of exercising EU Treaty rights in Ireland under Directive 2004/38/EC.

I would like to apply for the Ireland visas for my non-EEA dependent parents and brother, so that they can join us in Ireland. I believe they can be considered as qualifying family memeber and extended family member respectively.

I have few questions

I heard that it is taking longer to get Short Stay Visa C these days? So is it possible that they would apply for Short stay Visa C before I (EU Citizen) move to Ireland. Once they get initial short stay visa, i would come to Ireland with them. ??

Also, i noticed that all the questions asked in the C Visa Application form are opposite to what one would attempt to prove in the Residence Card application.

For e.g. it asks questions such as
Q1 - that you will leave Ireland at the end of your visit;
Q2- that you have sufficient resources to look after yourself while you are here;

If we say YES for Q1then application for Residence Card afterwards will be contradiction ?

What does respected members of the forum suggest?

There are big delays in visa processing for Eire. Check other threads in forum on this matter.
(Some members have given up and gone elsewhere; eg to Malta, France etc).

Yes, you can apply for visa to all move together to Eire.

Look for visa option for EEA family members not general visitors.

There are Centre of Life requirements for SS route but Is it necessary for the EU Citizen (exercising treaty rights) to move entire family to Eire. for family member's Visa C and RC applications.

I mean Is it possible that my spouse (British citizen) would only move to Eire, work there and demonstrate dependency of her parents in-laws for Visa C and RC.

If you are a British-based family with British sponsor and aim to return to UK (rather than emigrate to Eire 'for ever') then, yes, everyone needs to uproot and go. Put kids in Irish schools, take any pets with you & etc etc.
And UK home is best rented off or otherwise disposed of.

Otherwise you can ofcourse have a great time in Eire but then face denials and refusals of dependents on return to UK.

btw this is not due to the cleaner, purer EU law; this is due to the somewhat controversial centre of life 'wrapper' that UK has placed around EU law over time (and as transposed into the UK legal framework).

So, is it correct that for initial Short Stay Visa C, British Citizen does not necessarily have to be in Ireland ??

On the INIS website link below, in the Supporting document section it says "...provide a declaration or statement of confirmation that the citizen will be exercising those rights at the time of your arrival in Ireland.

So, is there any specific format or form for that Statement of confirmation? Or Would i just write a letter confirming the intent to move to Ireland with qualified/sponsored family members ?
