Hello,

I’m currently working in Northern Ireland under a Tier 5 TW (exchange) visa. My visa is nearly finish and I wish to apply for Tier 2 General (3years) because I was offered a full time job.

I have a problem with scoring the 70 points. I will be able to get 10 for English ability, 10 for maintenance, 30 for CoS but the problem will be with scoring the last 20 points for appropriate salary and allowances.

My job title is under the code 2129 Technical Engineer. New Entrant £26,100 (I’m 25 years old). This is too much for Northern Ireland. Even local graduate engineers don’t get this salary.

Is there any possible way to overcome the payment problem (but I still earn more than £20,800)?

No way at all.
only option is , if your sponsor can look and see if u can fit in some other soc code which has lesser salary requirement and u can fulfill that.

Thanks iworker for the quick answer, one more question tho,

What if the CoS will be issued with a salary that respects the minimum and then after getting the T2 proceed to a salary drop to whatever it suits the employer and myself ?
Will that have any inconveniences?

This question demonstrates a total lack of understanding and abuse of the visa purpose and process.

This attitude and behaviour from a sponsor and applicant will result in sponsor losing their license and your position in UK will be forfeit.

My problem here is to line up with the appropriate salary rate. I don t want to do anything that might get me into troubles. iworker idea to look into the other job descriptions to find a lower salary rate and description which is close to my actual job was good. And if possible I would like to hear more ideas that might help my case. The salaries in NI are totally different from what they are in in the other parts of UK and they are definitely under the salary rates stated by UKVI for almost all the jobs.
My company is thinking about hiring a specialized company to process the visa application. Does it help? Is it expensive?

Member iworker's suggestion seems sound and seems to be a preferable option.

If the company takes on an immigration advisor presumably they will foot the bill.

To be blunt SOC shopping is not an option. The role is the role, you can't "fix" it to meet a salary limit because it suits your need.
Employing an immigration advisor no more solves the problem either.

The whole idea is that have to meet the SOC regardless of where it is in the UK. Northern Ireland is not an exception and if the employer can not or is not willing to meet the requirements of the SOC then it can not assign a COS. If they conspire with you to jerrymander the SOC and thus issue a false COS then you and the employer will suffer the consequences.

The other issue - can you switch to Tier 2 without going home...

There is a world of difference between applying in the UK and out of the U.K.
You require a restricted COS if applying from outside the UK. They are subject to slightly more checks and balances.

The SOC and RLMT all has to evidenced to a higher degree for restricted COS.
