Spouse Visa Extension FLR(M)

Hello All,

I have few Queries regarding filling FLR(M) form for Spouse Visa Extension for my Wife and Daughter. My Wife lived with me in UK under

Entry Clearence visa to UK:

VISA HSMP PARTNER : 08 MAY 2008 - 07 JAN 2010

Inside UK : 08 JUN 2008 - 16 NOV 2008 - 162 Days
Outside UK : 17 NOV 2008 - 23 JUN 2009 – 219 Days
Inside UK : 24 JUN 2009 – 27 Feb 2010 – 249 Days

Extension (This is Limited Leave to remain i believe) :

TIER 1 (Dependent) Partner : 15 JAN 2010 – 15 JAN 2013

Outside UK : 28 Feb 2010 – 02 May 2010 – 64 Days
Inside UK : 03 May 2010 - 22 NOV 2010 - 204 Days
Outside UK : 23 Nov 2010 – 19 OCT 2013 – 1062 Days

Due to my daughter's health reason had to be in and outside of UK. Then i couldn't bring them to UK for renewal and Extension visa expired .

In 2013, i applied for Entry clearance with Family Settlement visa and now i am planning to apply for FLR(M) for extension.

Entry Clearance Visa to UK - as Spouse of Settled Person (I was with ILR at that time)

VISA SPOUSE/CP – Spouse/CP of 'spouse name' : 09 OCT 2013 - 09 JUL 2016

Inside UK : 20 OCT 2013 – 26 Feb 2014 – 129 Days
Outside UK : 27 FEB 2014 - 1 Apr 2015 – 399 Days
Inside UK : 2 APR 2015 - 18 MAY 2015 - 47 Days
Outside UK :19 MAY 2015 – 1 OCT 2015 – 136 Days
Inside UK : 2 OCT 2015 – tilldate 20 jun 2016 – 263 Days

( Currently i am a British Citizen and planned to apply for FLR(m) on 20 Jun this month)

While filling the form, Question 6.9
"
If relevant, have you lived together permanently in the UK with your sponsor since your last grant of limited leave to remain as a partner ?.

If Yes , go to question 6.16
If No, Please provide details of any periods when you have not lived with your sponsor since your last grant of limited leave to remain and any reasons why you have not done so. "

For this i am selecting "no" and providing details.

Is that (TIER 1 (Dependent) Partner : 15 JAN 2010 – 15 JAN 2013) visa extension relevant for FLR(M) extension, because at that time i was under Highly Skilled Worker visa ?. Or i should consider as no limited leave to remain as a partner is granted and answer "yes" and move to Question 6.16.

Please provide your valuable inputs.

Your Tier 1 Dependent Visa is not relevant here as they clearly asked "Since your last grant of leave as Partner". They have also mentioned " If relevant". This means it is relevant for those who are applying for extension. Tier 1 Dependent visa and Spouse visas are two different routes for settlement.

Your wife spent more than 50% time out of the country and that may cause problem. How will you provide 2 years cohabitation proof. Your case looks bit complicated and also you will not be able to apply for ILR even if you manage to get extension this time.

Yes i know there will be issue with ILR. Anyway now i first have to get extension.

To cover, For 2 years cohabitation proof. I have joint Bank account set for last 8 months, and few utility bills, council bills are there with both of our names. And mail converstions. And i am planning to keep some letter from NHS and letters received in India.
