FLR(FP) extension if spouse lives with her grandmother

Post by Sami 9191 » Thu Jun 02, 2016 3:24 pm

Hi.
I have been given 2.5 year on the basis of family life after been refused asylum.
my extension is due in the next 4 month currently me and my wife (British citizen) not living together and that's due to our young age we did live together before but found it hard and honestly our marriage is stronger and we both don't want lose each other we do meet about 3 to 5 times a week we have evidence(photos).
and also her grandmother is elderly and she is taking care of her she find it also hard to live away from her nana

I am really worried that my application will be rejected on the basis that we not living together.

I need Help from people who experienced extension of family life when they haven't lived together.

Thanks for reading my post

Yes, if your visa has been granted as a spouse and you are no longer living together, the application is likely to be refused. At present you wouldn't be considered to be enjoying a family life with your wife necessary to qualify for FLR(FP) as a partner.

Remember that it boils down to proof of co-habitation.

Are you have bank accounts/credit cards/mortgages/council bills etc. in joint names and addressed to the same address? Alternatively, if you do not have them in joint names, do you have such statements being sent to the same address? That should suffice as proof of a subsisting relationship.

But, as always, wait for feedback from others.

Is your wife registered as a carer at her grandmother's address and claiming carer's allowance? Do you live on your own or are you living in shared accommodation? How long have you been living apart?
