From PSW to ILR

Post by ilruk84 » Thu Jun 02, 2016 6:27 pm

Dear All,

I am asking this question on behalf of my very close friend he has been in very difficult situation, he applied for his PSW just before government planned to close PSW that was in april 2012 and since then he has been waiting for outcome though he tried chasing them but no answer. He then varied his application to SETLR in sept 2015 as he completed his 10 years without any breach of law or being here illegal his mp has return hem a letter and my friend has called HO many times but same standard reply, my question is what should be his next step is there any higher authority or kind of higher level he can approach to push his case any suggestion will be highly appreciated

Many thanks

MPs are generally the best route to getting a response from the HO.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

its funny but in that case probably I would buy some gifts and make a biggggg gift box and a letter inside to Home Secretary mentioning its been 4 years but still I haven't got your decision on any of my application. they will be eager to see the status of that application then sure :D

What response did the MP get? What is the standard response that you refer to? Is it that the application is under consideration? Ask them to put the file under active consideration (point 9 on the link).

On the positive side, if the Home office states (especially to an MP) that the application is still being considered, that means that your friend's Section 3c leave is still extant (assuming that he had it to start with).

Has your friend moved addresses? Has the Home Office ever got back to him asking for more information or proof?

Hi,

I haven't got the exact word but it was under process and they tell him this every time he called them and said same thing to MP. Yes he has moved the addresses but he varied his application through solicitor and it was added that any further correspondence should be sent to the solicitor.
To be honest its not only him who has this issue, my cousin applied for Tier1 Ent in May 2013 and only reply he had from HO was in Jan 2014 saying that they need more time as his case has been complex and after that no correspondence but he will be varying his application to SETLR in sept this year.

Regards
