Spouse of UK citizen going to Ireland

Post by hassanbeltagy » Sat Jun 04, 2016 6:26 pm

Hi all,

I am Egyptian married to UK/Egyptian wife.
She is in uk 9 months ago not working.

I get refused 2 times in family visit visa.

We are planning to move to Ireland using the free movement law for the EU citizens under the Derictive 2004.

What are the required paper to apply fo C visa from Egypt?
Especially the paper that will give them the prove that she is moving with me. Eg. She is in UK now.

Is it better that she returns to Egypt and let me apply using her original copy of her passport?

If she go to Dublin and ge PPS number, this will make our situation more strong?

Thanks for your reply

But does the 2 uk rejection will affect my case?
The reasons 1 is financial and when I replied with another application they accused me of hiding info that my wife was there first

What about the PPS number?

For applications made under EU law, previous domestic immigration history is normally only a factor in extreme cases that impact "public safety and/or public policy".

Obviously the authorities will be aware of it as there is significant cross-border data/intelligence sharing as per the UK/Irish CTA.

I don't know about PPS.
Stand by for other members.

Hi Hassanbeltagy,
Good Evening!

Are you planning to travel to Ireland to live or for a short Holiday?
You have mentioned PPSN, This is a document/ card required for people
who live and pay taxes etc. in Ireland.

If your wife (British citizen) intends to work or live in the Republic of Ireland then
she will need to obtain a PPSN.

I hope this helps. If you need detailed advise please ask or inbox me.

Thank you,
Best regards,

Aaron.

Hi Hassanbeltagy,
Good morning!

You still haven't specified what you and your British wife intend to do
In the state?
If the purpose of your trip is only a short holiday/ vacation then things would be different as supposed to if you were planning to live and work in the Republic of Ireland.

Either ways you will need an entry clearance/ visa prior to travelling to ROI.

Hope this helps. If not then, ask your British national wife to seek advise from a
solicitor in Ireland for clarification.

Thank you,
Aaron.

HI Ahmedadel,
Good Morning!

You will have to move to the Republic of Ireland and sort your housing/ apartment, work or business etc.
Then you can start your wife's application process.
According to the EU law your wife should be able to obtain an Irish visa from her country as long as you are exercising your treaty rights in the state. There is no minimum earnings or finance required as per the EU Treaty rights, to sponsor your spouse.
If you are a British citizen then there is a level of uncertainty at the moment due to the "Brexit" phase.

I wish you all the very best.
I hope this helps.

Thank you,
Regards,

Aaron.

That's fine.
Suggest start with the guidance in the Announcements (read me first) forum to get an idea how it all works.

And your question is already in its own thread (link above).
