I obtained ILR under long residencey. Prior to that i was on Tier 1 general and my wife was my PBS dependent.

I am going to apply for her spouse visa on FLR (M) application tomorrow.

Do i have to meet minimum financial requirement £18,600

Also do i have to fill in the 7B maintenance section.????

Pleas help....

Also i am getting child benefit for 2 children. Will that be a problem.

1.Minimum income level of £18,600 if your children hold British nationality. Do they?
2.Your wife will also have to pay the £500 surcharge in addition to the FLR(M) visa fee. Also relevant on the status of your children, see 1.
3. Claiming CB in your name only is correct. Child tax credits & working tax credit must be claimed in joint names.
4. 7B.You only need to complete this section if:
(i) You qualify for an exemption from meeting the income threshold element of the financial
requirement.
(ii) You were granted leave to enter or remain as a partner under Chapter 8 of the Immigration
Rules following an application submitted before 9 July 2012.

This doesn't apply to you.

The only thing is i am confused about section 7B. I know they say

This doesn't apply to you.

Also you have mentioned i do not have to fill this. My wife was last granted dependent visa as my PBS in 2013.

Also if i send the application with this section filled. Will the HO reject my application or will send back to correct or simply wont consider it .....

Also YES my both children have got british passports.

Why would you complete a section when your wife doesn't qualify on either point? :?
Your wife didn't apply for a spouse settlement visa before 9th July 2012 (she was granted a PBS dependent visa in 2013), and there is no exemption from meeting the minimum income level.
Yes, if you complete this section your wife's application will probably be returned as invalid and the fee will be lost.

I will only complete section 7A and will leave section 7B blank.

#it means then i will not even have to mention anything about child benefits as it asks in section 7B which i wll leave blank anyway. Right??

I am applying for first period of grant of spouse visa for my wife as she was a pbs dependent on my tier 1 general. since last 5 years. Do v have to attach shared responsibilities proof or that 6 proof of addresses as mentioned in the application form for last 2 years?
