Center of life test query

Post by zahmed05 » Mon Jun 06, 2016 1:11 am

Hi All,

I'm planning to move to Ireland to setup my consultancy business and excercise my treaty rights. I'm British national.

If I excercise my treaty rights in Ireland With my family but still continue to work remotely for my existing company as UK employee for forseeable future, will I fail the Center of life test based on the fact that I was always employed in UK?

Regards,
Zeeshan

Quite possibly.

Because a question could be: why would you need to live in Eire in order to pursue this economic activity in UK.

Thanks a lot.

Actually, I don't want to risk the job until the consultancy business gets established. I do have the option to work remotely so I would like to keep it for the time being.

I believe I can still get family parmit for mom in EU even I'm part working for a UK company. Is that correct?

I may not be returning to UK if the business goes well.

Not sure what you are asking.
Do you mean get a 'FP' for mom to enter Eire or another EU country?

FPs are issued by UK only, and only for entry into UK.
Centre of life rules only apply to BC and family returning to UK.

To enter another Union state a non-EEA national would typically need a Schengen visa. The issuing of such a visa would not depend on where you worked.
