General immigration questions

Post by Mr101google » Tue Jun 07, 2016 2:20 am

So I am not sure if this is the correct place to post this. So I am sorry if it's wrong D: oops.

But here's the rub, I am a Citizen of the United Kingdom since birth. I wish to move to the Republic of Ireland to remain there and live there, whilst working. Basically become a Citizen there. Live there permanently. My girlfriend from the United States we also wish to get married in the Republic of Ireland once I have settled there properly and got set up.

My questions are:
- What do I need to do to be able to permanently reside in the Republic of Ireland.
- If my girlfriend gets a fiance visa for the republic of Ireland, does she have to leave again in order to get a visa to stay with me permanently ?, or can she apply straight after we've got registered and married ?.
- What does my fiance need to stay with me in Ireland permanently with me.

Note: We're not looking to go down the Singh route, we want to both stay in Ireland permanently and settle down. My reasons for not staying in the UK is because I much prefer Ireland, personal preferences I've visited the wonderful country plenty of times.

My age is 24, my fiance is 20 that's just some basic background info. She's a US citizen living in Colorado.

PS: Thanks for any help given :) sorry if it's in the wrong place I am new here. Just needing serious help so I can get set on track.

Hi Mr101Google,
Good Afternoon!

Considering the facts that you have mentioned above and the questions asked please find the answers as follows:

Q1. What do I need to do to be able to permanently reside in the Republic of Ireland.
Answer1. Simply move to the Republic of Ireland with your British passport and you can start seeking employment or start your business etc... As mentioned above.
As a British citizen you enjoy the freedom of movement within the EEA at this time.
Things may differ if Brexit occurs.

Q2.- If my girlfriend gets a fiance visa for the republic of Ireland, does she have to leave again in order to get a visa to stay with me permanently ?, or can she apply straight after we've got registered and married ?.

Answer 2. You will have to check with Health a Services Executive (these are the guys that may permit you to marry a Non-EEA national in ROI).
If you are allowed to marry your Non-EEA girlfriend then, she can apply for residency on the basis of your marriage in-country.

Q3. What does my fiance need to stay with me in Ireland permanently with me.
Answer 3. As long as you are exercising your treaty rights in the ROI and remain married to your wife. She will need to apply for a residence card as mentioned above and not break the Irish law.

I hope this helps.

Thank you,
Best regards,

Aaron.

Thank you very much for your help, this is really reassuring sounds like Ireland is so much kinder and nicer. Me and my fiance thought we'd be apart years, but this is a great way to be together in a beautiful country. Let's just hope no Brexit occurs :(

I agree that Ireland is a lovely country and the vast majority of the people are very friendly.

Even if there is bretexit, the people least likely to be affected will be Irish.

Your concern will be settling wit your partner.

It may be more smoother foe her if you married.
