Hi All,
I currently have a T1 (50k) visa which is due to expire in July 2017, and I am currently trying to determine whether I have met the requirements to get a 2 year extension.
I believe I have satisfied all the conditions for the extension, except for the creation of two jobs for British/EU citizens settled in the UK - I am looking for some advice as to whether my current evidence would/wouldn't be sufficient to demonstrate I have created 2 jobs...
The 2 jobs I believe I have created are within an incorporated company, which I formed in July 2013 with two friends (1 a UK citizen and 1 a Croatian National with a right to work in the UK under a yellow certificate).
We are all equal shareholders in the company, we are all statutory directors, and we are also each paid a salary (with the company taking tax at source for PAYE/NIC and paying employer NIC).
I believe this last point means we are also employees of the company under employment law - and therefore it is my two colleagues that would qualify as the job created to satisfy the visa extension condition.
Can anyone advise as to whether this scenario would meet the conditions for the job creation element of the visa extension??
Another question, if they do counted as job creations but as I established the company back to July 2013 under my PSW visa therefore will they be counted for T1 50K extension or the job creations have to be within the 3 years T1 period?
Thanks for your time.
Best,
David
