EEA FM, Nothing received for over a month!

Hello,

I am a spouse of an EEA national who is currently working. the home office received my EEA fm application on the 3rd of May 2016. then the payment was taken on the 6th of May.
in the mean time, I have found a good job in a good company, and they wanted to see my original passport, or any paper from the home office that confirms my right to work, even if it was the case ID number from the biometrics invitation letter that they could use to contact the home office and confirm my eligibility to work in the UK.

But, and till today, I have received absolutely nothing back from the Home office!
I have contacted them on multiple occasions, emailed the biometrics center.. and got nothing !

I was suspended from work, and given merely a few more days to prove my eligibility to work, or else my position will be given to someone else and will loose my job.

Please help !

You have a right to work by virtue of the Directive even without paperwork; the challenge is to prove it to uninformed/untrained/unaware employers & HR departments.

Did you enter UK on a FP? is it still valid?

thanks for the reply.

Yes, I have entered on FP, and it still valid.
The home office have told the employer they can employ me untill my permit expires, on the condition that the see the ORIGINAL passport.
as you can tell, my original passport is with the home office with the rest of my application.
and if I ask the home office to return my passport, then that will reset my application when I send it again, and my passport has entered the "6 months till expiry" period AFTER i sent.
so, asking for my passport back, means I will have to renew it before sending the application again, by then my FP would have expired and I will have to leave coz there is no application going.
so even if I asked for it back, I will not be able to work.

The permit provides employer with a statutory excuse that they have checked you out..

Even if expiring in 6 months your passport will be valid when you get it back, if you're lucky in 10 days or so.
Why isn't that good enough to show?

Don't know what you mean by resetting the application, what's that all about :?:
You can get docs back without withdrawing the application.

You don't have to leave when FP expires. Who on earth have you been listening to :?: :!:

:arrow: As already mentioned, your right to be here is by virtue of EU law.
Not by some RC. A RC is optional and its just a confirmatory document.
That means it doesn't give you any rights. You have them already.

Bottom line: you have a right to work as long as spouse/sponsor is in UK and exercising treaty rights (and you remain married).
If you are discriminated against or even fired then sue the employer.

I read that asking for my passport back, will reset my application when i send it back again. if it does reset it, then I will have a big problem.
So are u 100% sure that it will not be reset when I sent it to the home office again ?
and how long till I get my passport back IF i email the home office to send it?

You don't email HO about this - just use the link I posted for you (above).

:arrow: Make sure you choose the option NOT to withdraw application :!:

They aim to return in 10 days. Some members reported as fast as 4 days; others have reported a delay.
There's no guarantee - all you can do is go for it.

if you do it now at least there are no more public holidays coming (which could have explained the previous delays).
