3 months Gap in 10 years

Hi

I have a questions with respected Gurus here , if an application is rejected & Administrative review is also rejected and applicant is short of 1 & half month for 10 years duration , can he re apply under same category & once he reaches 10
Years he can vary application for ilr ?

Like making a fresh application after rejection of 1st one & by the time reaches 10 years period
