Re-enter as Tourist after Tier 5 expiry

Post by lzt21 » Fri Jun 10, 2016 12:40 am

Hi,

My (about 3 months) Tier 5 visa is due to expire on 18th June, and I need to attend my girlfriend's graduation ceremony on the 23rd June. I have booked a flight back to my home country on the 28th June with the knowledge that I could re-enter (any point in time between the 3months visa validity period) the UK as a tourist.

My question is, is it worth it to risk overstaying for 10 days? Do they have any track of records if I overstay?

And what is my success rate to re-enter if I were to leave on the 18th and return on 20-21st with proof of documents (booked flight tickets)?

Who is they? Do you mean UK Border Force and the Home Office?

Its possible they may 'notice' the stay without leave and update your immigration history accordingly.
Not cool if you have ambitions to return to UK at some point. Expect questioning at very least.

If you overstay then return on a visitor visa you can expect to be returned as soon as you land back in the UK.

It would be wise to heed Frontier Mole's advice.

I'll leave Frontier Mole to respond. They have far more experience with this issue.

You have to decide what your future plans in regards to returning to the UK are?

I do not condone overstaying in any shape or form and my usual advice is go home on or before your visa expiry date. But if that is not an option then understand the consequences.

If you don't intend to return for at least a year then overstaying will have little consequence if you stay upto 28 days beyond expiry. Get beyond 28 days then the consequences are entirely different. Don't expect visa free entry to the UK at any point in the next 2 years. Non visa nationals that overstay by more than 28 days can expect a very rough ride coming in without a pre approved visitors visa.

Stay beyond 90 days and forget visa free entry period.
