Morning all,

My Tier 2 General visa application has just been refused on the basis that I don't meet the experienced worker rate. My wife's application as my dependent was therefore refused.
My SOC code is 2135 which is £33,000 pa on 39 hour week for an experienced rate.
I earn £29,608 pa on 37 hour week which equates to £31,208.43 on 39 hour week, hence the refusal.

I want to reduce my working hours to 34 hour week (same SOC) and my employer is supportive and has approved it. This means I will be earning a salary that equates to £33,962.11 pa on 39 hour week and therefore meets the experienced rate. In hindsight I should have done this before my refused application as my wife is expecting

Please I need advice as my current visa will soon expire
  • 1 I can provide all the evidence to show that my wife is expecting during a new application. However will it classified as a genuine vacancy since my refused application was based on a 37 hour week job? Is there any specific evidence I or my employer will have to produce?
  • 2 Is there any guidance on what happens if your hours are reduced and different from what was on your last COS but still in the same job?
  • 3 If I reapply will it be treated as an extension or brand new application?
  • 4 Is there any other thing I need to be mindful of?

Reduction of working hours to meet the experienced rate of pay is more than likely going to lead to one of two things

Another refusal based on the fact that it is not a genuine role if if is being jerrymandered to fit the SOC

Your employer will get a visit based on the above and have their license revoked

Best advice is get the employer to up the salary to meet the rate.
