What's your experience with EEA FP soon after wedding?

Post by eniseg » Fri Jun 10, 2016 7:58 pm

Hi everyone,

I keep seeing people highlighting that they are worried because they applied for the EEA FP soon after their wedding. And apparently some people have been rejected because there were only them in their wedding photos.

My husband (Australian) and I (German student in Scotland) applied online the day after our wedding. The reason for this is that we want to be together in the UK asap, and we want tp have the certainty of the Family Permit asap. His future employer has requested the FP as a statutory excuse to employ him, we know Aussies aren't visa nationals and strictly speaking don't need it.

In our wedding photos, there's also just us. We had a tiny wedding (us and the two witnesses) because that was always my dream wedding. We didn't give an explanation for this in our cover letter.

I wrote a lengthy cover letter detailing my treaty rights and our circumstances, we also submitted lots of photos of us before the wedding, and how we kept in touch (screenshots of skype, messages, phone calls), flight tickets etc. We did get married after only 6 months together...

What's people's experience with this?ä

We are on Day 12 out of 15 waiting for the FP outcome and it's nerve-wrecking for us.

I don't think you can correlate success to marital sentence served.

There have been initial refusals. recently. of FPs on relationship grounds for married couples of even seven years or more.

Ops, it was meant to make you feel better.
(The member won her FP to join hubby on second application).

Oh, thank you then. I just thought: well, if they doubt marriages of 7 years....

We will have to see how much time there is. His employer will not hold the position for him eternally, eventually his starting date would be moved to April 2017. And especially my husband finds the permanent geographical separation almost unbearable. :( So it will take a massive toll on the relationship...sorry for whining and complaining here all the time!

I'm so worried about our outcome that my brain keeps making up new reasons to fail:
forgotten bank statements from me as the EEA national
just us in wedding photos
applied the day after wedding

et cetera

plus we were told that after June 23 the FP route won't be possible anymore

Who told you that? Do they know something we don't?

On a serious note, whatever the results of the referendum, there will be a delay of days at least, if not months, before changes to the rules and laws. So, in the British tradition, calm down and carry on.

We contacted a company named xxxxxxxxxxxxxxxx

One of their employees contacted us, saying that their interpretation was that his Family Permit needed approval before June 23, 2016. Then he would still be able to get an RC. Not sure if I should disclose the guy's name?

He referred me to this: http://www.xxxxxxxxxxxxxxxxxxxxxxxx

Nobody knows.
All speculative.
Details removed to protect the innocent.

You may as well face your demons.
Here's a refusal for FP for an applicant with 17-year marriage with 2 kids under his belt.

Note the blatant disregard of HO's own guidance - HO certainly play hardball.
But its a sticky wicket as decisions like this should be overturned:

Yeah, I've seen that post. :P I've read a lot of the related posts...it's just that I was looking for something like success stories, even on Google, and they are hard to come by!

Apologies, I didn't realise you can't put company names here. I had them mentioned before, in a post, and they were not deleted then.

Its simpler not to post such identifying details when discussing 3rd parties who don't have an immediate right of reply.

And many people are granted FPs too.
Its mostly the problem cases that get posted here.

Eniseg, I hope you were successful in your application.

For the sake of future readers, my partner and I applied for an EEA FP about 2 weeks after getting married, and got the FP successfully on the first attempt :)

Well something doesn't look right to me, never seen a dream wedding like that, also you are too much worried which is not right , if you think you are genuine couple then cool down have patience and good n night sleep, you will get your RC sooner or later if you get refused in first attempt the appeal will take nearly 11 months to get reply from Court, i hope you get RC food hubby soon.
