Applying for EEA PR Card - QP or FM route for EU National

Hello All,

Apologies if wrong thread . . . . .

I am a British citizen, born in London in 1968. My wife is a Belgium citizen, born near Brussels in 1975. We met in London in 1996 and got married in 1997. We were both working until the birth of our child in 2000. Due to our daughter’s disability @ birth (born premature by 2 months) we agreed that my wife would be a “stay at home” mum and I would be the breadwinner. We have lived together in the UK since our marriage.

In 2015, my wife applied for naturalization but was declined because she has not “exercise” her treaty rights in the last five years, namely the lack of Comprehensive Medical Insurance.

We would like to apply for an EEA PR card and are a little confused as to which form is suitable for my partner’s application. Any advice would be greatly appreciated.

Your wife will face the same problem when applying for PR.

If you do not have some sort of comprehensive health cover in place (which would transform your wife into a self-sufficient qualified person) then suggest set up a CSI policy for her (asap). Or she could do it herself.

This would fully regularise her position in UK and start her PR clock running.
In 5 years (assuming no Brexit) she would then be in a position to think about confirmation of PR.

Possession of a PR card is now a mandatory prerequisite for the privilege of citizenship.

At the moment your wife only has a basis to be resident in UK through her (and your) child.
The derivative right she (probably) has does not lead to citizenship.
