Not satisfied with proof of residency - reconsideration

Post by JohnDjib » Fri Jun 03, 2016 8:48 am

Hello same thing happen to me i have applied for naturalisation and sent my application with my brp card wich had my ilr.and they asked travel document covering from january 2011 to january 2016.i have sent them my certificate of travel wich i never traveled on issued on feb2012 and expiring 2017 and a letter explaining how i lost the paper the HO granted me ILR in feb 2005 and only applied in 2012 for a certificate of travel and asked them to give me some time as i called HMRC/DWP and they told me it might take 2 weeks if you want those proof and they asked to write a letter if you want from 01/11 to 01/16.they refused my application due to not being satisfied with my document and if i want i can make reconsideration .i called them 20 time to ask for a why they not satisfied with my document and why they didnt give me more time to supply other evidence that i never left uk in 15 years since i came here and the guy on the fone said just do reconsideration bring more proof and its up to the discretion of the caseworker if they gonna give more time bye.i filled the NR form and said i havent been given more time when i request and provided from HMRC employement and benefit history without gap from 2010 to may 2016 and printed 250 page of bank statement from 2010 to 01/16 .now im waiting putting my hopes up they will say but my heart is beating fast .but thinking they issued my son his british passport using my travel document in 2013.

Home office guidance does mention if your passport doesn't get stamped to submit employer letter etc for proof of residence, but they really don't make it clear that you should send residence proof anyway for the whole 5 years just in case (for example like for yourself where you didn't travel at all).

Some NCS explicitly only ask for passports and can even be reluctant to send more than P60s to cover that time. I am fully expecting a letter from HO asking for more evidence than my P60s as NCS didn't want to send my tenancy agreements etc.

5 years (or 3 if married to BC) continued residence in the UK is a requirement for citizenship regardless of your route of applying and whether you held ILR or PR.

I filled the form NR and send all back my certificate of travel dated 02/12 to 01/2017/also my brp card with ilr ,HMRC proof of employement and benefit claim since 2009,bank statement from 2009 to to 2014 wich was around 100 pages double sided and wrote a letter explaining that i have been issued ILR IN 2005 on a paper and lost it and wrote to ukba back then in 2006 request a replacement so i could prove to my employer my right to work in uk but they reply saying they dont do replacement of ilr paper if i need one i need to apply on NTL form so i didnt need it since i was working from 2007 to 2012 and the home office was working in the olypmpic issuing the ID so they checked and in 2012 i applied for the certificate of travel wich was useless as even coulnd withdraw cash from barclay bank as they dont accept .So in my case im thinking the caseworkers dont contact HMRC,DWP and all them other departement to check my history for the last 5 year and just looked only at my travel document issued 02/2012 and just refused my application by replying (we received your reply to our request but the home secretairy is not satisfied from the document you provided that you meet the residence requirement and your application is refused.im thinking after i requested a reconsideration if they refuse me after i provided from HMRC proof of 10 years and bank statement for 7 years if they refuse me and take my money from 1277 refund me 80 its not fair .

To avoid confusion & jumbled responses, I have moved your topic to its own thread (this one).
