Non eea After divorce please Help

To all members Please need you expert advice

1 .i married to EEA national and i am non EU national

2. We married in December 2010

And i was given EU residence permit for five years which will expire early Oct 2016

Things getting worst and started divorce in Feb 2016

Decree absolute issued June 18th 2016

I hv been both working through my time

Ex eea spouse working full time from 2009 till last year April 2015 and start self employed from April up to date

4. The day divorce procedure start we was married for 5 Years 2 months .

My question is can Tell HO and Apply for RoR or I shld apply for PR straight

The solicitor I contacted told me to apply for PR since Is just few month left for my Rc to expire

We was living together all this time in UK and have all proof means Bills, Council tax ,hmrc letters, her P60 and payslips during work time from 2009-2015,my P60 and Payslips and etc.

To be Honest i don’t really know what to do my Brain is off now Please Guide me what shall i do ?

Don't worry about the dates on your RC. That's null and void anyway now that you have divorced.

Your activity in UK is probably immaterial, its all about wife exercising treaty rights as your sponsor..

Is wife an A8 national? If so make sure she was fully and properly registered for WRS.
Since becoming self-employed are you sure wife's work can be considered genuine and effective?
Be aware HO will also apply their MET/PET tests to assess the work. If that all checks out then all good.

Suggest shoot for confirmation of PR possibly/probably acquired at time of 5th wedding anniversary.
Based on stated facts, your spouse/sponsor has been a qualified person from your wedding through to your anniversary,

This assumes neither of you enjoyed any prolonged absences from UK.
It also assumes you have rock-solid documentary supporting evidence since 2010.
(If you are now estranged there's ways and means to get this).

We don't have any prolong absence from uk

And her work Is genuine and effective, she's an hairdresser

Working from home,Tax return of year 2015-16 in place,

Bank account of money showing customers paying in and invoice for customers paid in cash.

Adverts on yell and 192.com,flyers and business card,

All I will just need might be profit and loss account from April

2016-June 2016 when decree absolute was issued.

Shoot directly for PR, looks like you acquired it by late 2015.
