Stopped at airport mistake on visa - now in detention centre

Post by gameguruelite » Wed Jun 22, 2016 4:39 am

hi all

I have a friend who was stopped at airport with a vistor visa. the reason for her to come over was for a exhibition for which she had a ticket for.

but because she had missed the exhibition was detained for questioning at that point she realised she had made a miistake on her visa saying she did not have any family or friends in uk for which she did. her forms were filled in by someone else on her behalf.

The Immigration Officer issued her with a One Stop Warning, Notice to detainee and a Notice of a cancellation of leave letter.

she has come to uk almost every year and has never overstayed and always returned on time also she has been around the world to.

but becasue of the mistake of not disclosing that she had family and friends. they have refused her entry even though she has had a clean record and no criminal offence.

the one stop warning letter says she can appeal within 14days of this decision and the notice of cacellation has a administrative review she is unsure which action to take. also in the notice to detainee she has ticked boxes
b. there is insufficent reliable information to decide on whether to grant you temporary admission or release.
and
5. you have failed to give satisfactory or reliable answers to an immigration officer enquries.

basically the immigration officer didnt believe she didnt have her own beuaty business in india and prob thought she didnt intend to go home even though she has never overstayed and has a son back home in india.

are there grounds to appeal

thanks all

Doesn't sound like it.

Friend is evidently very absent-minded by forgetting not only to go to the exhibition (not fulfilling stated purpose of trip);
but also forgot about family/friends she quite likely sees every year.
As well as forgetting she is responsible for the visa application she filed and must have signed for.

Hard to see where IO has erred here in applying what are very straightforward rules and procedures that someone who visits every year should know inside out.
