Tier 2 to PR or EEA2 to PR?

Tier 2 to PR or EEA2 to PR?

Dear all,

I am non-EEA member who have worked under Tier 2 visa for 2 years. I am about to get married soon. My fiance is a french and he is a qualified person who also works in UK.

Can I have two routes to PR at the same time?
if I don’t apply to EEA2 when I get married, Can i still apply to PR after 5 years as family member of my husband?
if I apply EEA2, Does it means I can’t apply for PR in 3 years time under Tier 2? I don’t want to lose the 2 years I built up.

You have to choose one migration route or the other.

Yes, RC is optional.

Tier 2 time doesn't count towards acquiring PR as you weren't married and didn't have an EEA sponsor who was a qualified person at that time.

May I ask you a little more just to confirm please?
If I get married and I remain as tier 2 (do not apply to EEA2) now. if in 3 years I couldn't satisfy tier 2 condition for PR then I can still apply for PR in 5 years time(from now). Is it correct?

In principle yes, but it depends on a number of factors:
  • if sponsor remains a qualified person;
    no prolonged absences from UK;
    you remain married;
    no Brexit;
