When should I apply for Permanent Residence Card?

Post by Moustafa2 » Fri Jun 24, 2016 7:27 am

Hi all,

I arrived in the UK on 7 July 2011 on a Family Permit.
Got my Residence card (EEA2) on 25 October 2011 valid for five years.

When should I apply for Permanent Residence Card on 7th of July 2016 or 25th of October 2016? Or when should the five years needed to apply for permanent card is calculated from, the day which I entered the UK or the date the residence card was issued?

I appreciate your advice and thank you in advance.
M

Possibly neither of those dates.

It all depends on your sponsor, do you have a sponsor? who are they?
Are they exercising treaty rights as a qualified person?
If sponsor is a spouse how long have you been married?
Any prolonged absences from UK?

Hi noajthan,

I am married to EEA national since April 2011. We got married outside the UK and came together to the UK and have been living together ever since. We both entered the UK on the same day 7 July 2011.
My Spouse is a qualified person and has been continuously working since we arrived in the UK until now.
Neither her nor I have been absent from the UK for long time.
I checked all requirements for Permanent Residence Card and made sure we both comply with all requirements. I am only confused as to when I should apply.

Sounds like July 2011 - July 2016 then, on 5th anniversary of arrival in UK as the direct family member of an EEA sponsor/qualified person.
(The RC date is irrelevant).
