EEA Family Resident card refused

hI,

I applied for a family permit as a family member of an EEA national from Denmark. we made an application using the basis of my wife being a jobseeker which she was registered as. The reason for refusal was stated as thus: YOU HAVE FAILED TO PROVIDE ANY EVIDENCE THAT YOUR EEA SPONSOR WAS A QUALIFIED PERSON PRIOR TO BECOMING A JOBSEEKER. Can you please explain this line and advice on how to proceed with my appeal.

Note: i submitted her credentials from the UK universities she just finish her master degree before we got married as proof that she was a student before becoming a jobseeker and thus has good chance of being employed..

Did your wife have CSI as a student?
If not she won't be recognised as having been a student qualified person ie in a migration context.

as at the time she graduated in 2014 july, CSI was not an enforced requirement though she had the EU health insurrance.. but at the time of our application YES she had a CSI covering Her, our son and myself.

CSI has been enforced as a requirement for EEA students since 2011 (and has been a requirement since 2006 when UK EEA Regs came in).

You need to have presented evidence that sponsor had CSI (or foreign EHIC or some other alternative) to demonstrate she can be classed as a student qualified person. If you did not do this she will not have been treated as a qualified person. (Being a student and graduating is not enough).
