Self employment- full financial year clarification

Post by Jatpunjabi » Thu Jun 16, 2016 3:54 am

Hello all,
I'm very much confused with the definition of full financial year. My brother in law is going to apply for his spouse visa extension in July as it expires in September. Both my sister and my brother in law registered as self employed in December 2015. They have earned over the £18600 required for the visa but that money was earned from December till 5/04/16. They've done all the tax returns and National insurance etc.
Is it going to be a problem that they earned the money in about 4 months and were not self employed for the full tax year? I read somewhere that full financial year refers to the documents for the full year rather than the person working for full year. Again to stress they do meet the £18600 requirement as they're combining salary.
They're private tutors and all the money is paid to them in cash. They do put all the money into their account each month and use it throughout the month. Their bank statements show all that so they meet that requirement too.
Both are sole traders and have no accountants or anything like that. Will bank statements and tax returns be enough to prove the salary?
Sa302/Sa300- are these just the names of tax returns.
They're still working as self employed. My brother in law also has a part time job for which he earns around £600 per month. Before they were self employed that was the only job they had. So us family members were helping them.

I do apologise for the length of this post. I just wanted to give as much detail as possible.
I'm new here and it's my first post and do thank all of you in advance and look forward to your guidance. Thanks you all

My understanding is full financial year refer to tax year runs from 6 April to the following 5 April you may not be self-employed for a year or more if apply under CAT F but your income (pre-tax profit) since the start of your self-employment should be at least £18,600 in financial year

Thanks again ILR1980. After more research it seems that is the case but can anyone please share your experience if you went through similar process or can someone just add to ILR1980.

The link below suggests that one can be self employed for only part of the financial year but s long they earn the minimum £18600. Could someone please clarify is its the case. Thanks.

Could someone please also guide that if one doesn't meet the financial requirement for spouse visa extension then is it possible to apply for a different visa. I heard you can apply for family visa (10-year route). Is that correct? Does a spouse qualify for this?

Urgent: Financial Requirements not met. What are the options

Post by Jatpunjabi » Wed Jun 29, 2016 3:15 am

Hi all
I'm suppose to be applying for extension after initial 2.5 year stay on spouse visa. I don't meet the financial requirements or that's what I think. Can I apply for 10-year route and switch back once I meet the requirements? I will meet the requirements next year according to my solicitor. If it's possible then is it as simple as just reapplying again for 5-year route? The first 2.5 year stay will be counted towards 5-year or do I start new 5-years?
My solicitor has informed me that if you apply via 5-year route and don't meet the financial requirements you'll automatically be considered for 10-year route. He's saying that this is true even for the same day premium service. Anyone can shed some light on this please.

1, FLR(FP) 10 year route
2. Vary to FLR(M) when you meet the requirements.
3. Varying will set the to zero starting a new 5 year route to settlement.
4. Nothing is 'automatic' or guaranteed
5. Apply by post. A decision won't be made on the day at the PSC.
