A Thai friend of my wife came to the UK on a spouse visa and last year was granted flr(m). She has now separated from her husband (not divorced) and they have a child together.

She phoned the Home Office to tell them of her separation and they told her she would have to apply for another visa and told her to contact a lawyer. Does anybody know which type of visa she would have to apply for ?.

I believe she is also struggling financially - her husband only gives her £200 per month which includes £82 for child benefit. She works 2 days per week at KFC and 3 nights per week in a Thai restaurant. Would she be entitled to claim Child Tax Credit ?

She should apply for FLR(FP) parent route.

Unlikely that she will qualify for Child Tax Credits as these can only be claimed as a couple in joint names. She has no recourse to Public funds and so unable to claim on her own.

It may be wise for her to speak to her local CAB for advice on child support and maintenance from her estranged husband.

The father has to pay at least a set amount, based on his wages and any other children he has to pay towards. At the moment, he is only paying £27 a week towards this child's keep. They will be able to tell her what he should be paying and give her advice.
