Naturalization application with extended absences.

Post by path2ukcitizen » Thu Jun 30, 2016 7:36 pm

Hi Gurus,
I will be applying naturalization application on 30th of Sept 2016, I am planning to apply my wifes application along with me. She got ILR on 1st Oct 2015, And she came UK some time in 2011. As my wife was sick some time in 2014 and admitted for 10 days in GP. And she went to Home country for bed rest. After ILR she was completely in UK. We have some leave plans some time in Aug. All together, While applying for naturalization application she will be away from UK 495 days and if i consider 3 years route total 358 days. I spoke to GP, They agreed to provide a letter for her absence for 164 days. And don't have own house or limited company in UK.

In this scenario, What are the options for her to apply naturalization ? Please suggest your opinion, How can we proceed further in this case.

Regards,
NS

Wife cannot apply before October anyway. Check proof of physical presence in UK 5 years before date of application.

Suggest defer travel and/or defer wife's application until some of the excess absence has 'timed out'.

Hi Noajthan,
thanks for your reply, She was physically present in UK, exactly 5 years back. As i have some personal problems in my home country and financial problems in UK, I am not in situation to avoid my current travel plan. So if i post pone her naturalization application on 12/05/2017. she can apply naturalization based on 3 year route and meeting all requirements. But i am not sure whether i can get new job to survive till that time.

So if you consider applying her application along with me on 30th Sept 2016, As an independent application i.e 5 years route with 495 days absences and providing NHS letter along with application. What are her chances to get approved ?

Do you have any such cases i.e. extended absences for medical reason ?

Regards,
NS

Your wife is placing her destiny at the discretion of the caseworker.
I can't comment on the likelihood of success as I don't have inside knowledge of HO workings.

The guidance is clear your wife is likely to need to prove more years residence in UK based on that magnitude of absence.

See HO guidance:
