hi there,

i am on a tier 1 entreprenuer visa under the "new rules" .. i have company 1 and company 2..

company 1 trading export and import... and company 2 takeaway.....

i had one worker in company 1 for 10 months and he decided to leave i immediately replaced him with someone else for the 2 remaining months so that the job post lasts for one full year and hopefully count towards my visa extension....


company 1 is now dissolved and the worker that i used to cover the 2 months wishes to work in my company 2 takeaway . my question is if i offer him a job in company 2 will the job count towards my visa????? or will HO say that i used him to cover on post therefore can not count in company 2.....


i know it is a tricky situation and i can't seem to find a definitive answer...

Technically you created two positions in two separate companies, so it should be acceptable. However I strongly suggest you hire someone else as you have the risk of HO interpreting this differently.
