Child benefit-Tax credits EEA PR application

Post by vulcan29 » Mon Jul 04, 2016 5:33 pm

Hi, we are an Italian couple, having lived in the UK for 11 years and exercising our treaty rights for at least 6 years. We are going to apply for the EEA PR card (due to Brexit!). We have also two (British/Italian) children and we are claiming child benefit, and we did claim a bit of child tax credit a couple of years ago (no more now due to higher salary). I can see that now in the new form they include Child benefit and Tax credit to be reported. Do we need to report these, or are these only for the non-EU people who are applying for EEA PR when married to a EU citizen?
Thanks

It's not actually necessary to complete that section at all.

To make your life easier (as you are both EEA citizens), have a look at this form instead: https://dl.dropboxusercontent.com/u/128 ... ple_v2.pdf

Many thanks for that. I found a similar (abbreviated) version online but I was worried that they may cause issues so I have already completed the "normal" one. I will just remove the section about Public Funds and send the rest. If they ask about it later on, is there a link to a law where it is written that I do not have to provide that information? Thanks again

Sorry, one more question - in the form that you kindly shared, would I need to show also earnings (P60 etc.) of my wife (EEA as well)? Or are mine sufficient?
Thanks

There is no need to show earnings at all as long as the work is genuine and effective. If your wife is applying as your dependent rather than in her own right, her own economic activity is immaterial.

The form I linked above is a modified version of the EEA3 form from 2011 which has been put together by members of this forum to bring it in line with current regulations. As it states on the first page it requests only the minimum amount of information required for this application, and legally it cannot be refused purely because it is an old or wrong version of the form.

You can see exactly what information needs to be provided by reading the caseworker guidance here: https://www.gov.uk/government/uploads/s ... s_v3_0.pdf

Suggest reading pages 18-20. :)
