PR - 5 year Qualifying Period Questions

Post by theacidpope » Tue Jul 05, 2016 7:04 pm

Hello :)
I have a few questions regarding the PR Application form please.

I rang the home office several times for advice, but everyone tells me something different.

I am German and have been in the UK since 2003.

As my qualifying period I will choose the last 5 years from 2011 - now (to avoid putting down my time as a student as I didn’t have EHIC).

I have the following questions:

- Do I give 2003 as my date of entry in the “Date you fist entered the UK” box on the form, or the date from which I would like the qualifying period to start (2011) ?

- In Section 9 A (2) Employment and Section 16 State Benefits - Do I give details of all my employers/ Benefits received in the past 13 years, or just the last 5 years I chose as my qualifying period?

- In Section 9 A (5) and (6) ( Studies and how they were financed):
Do I even need to mention about my studies and student finance if they happened outside of my qualifying period?
When I spoke to a lady at the Home Office today, she told me to put my studies on the form, but not to send any supporting documents.
I am confused as to whether I should put information about my studies in Section 9 A(5) and (6),
OR just in section 9 A (1) where you give a general summary of your activities.

- My final question is - I have been self-employed for the past 5 years, but have a low income so I receive tax credits and housing benefit. Will this affect my PR at all and is likely to cause problems?

Many Thanks for your help! :)

The 2003 date

Only the 5 year qualifying period. You don't need to complete the section about benefits at all.

- In Section 9 A (5) and (6) ( Studies and how they were financed):
Do I even need to mention about my studies and student finance if they happened outside of my qualifying period?

No.

- My final question is - I have been self-employed for the past 5 years, but have a low income so I receive tax credits and housing benefit. Will this affect my PR at all and is likely to cause problems?

As long as the work is genuine and effective, it is not a problem.

Have a look at this form instead: https://dl.dropboxusercontent.com/u/128 ... ple_v2.pdf

Thank you SO MUCH for your helpful reply and the form! :D :D :D

Much appreciated!!

I am a little worried about not earning enough, as I just realised there seems to be a Minimum Earnings Threshold, which I have not met the past 5 years.
Is that likely to cause a lot of problems?

Many Thanks again!!

HO is likely to apply its MET/PET test to you. This goes over and above EU law.
